New Delhi:TheSupreme Courton Friday made an important observation on reservation and social mobility. The top court questioned families despite attaining educational and financial progress and continuing to seek quota benefits. The apex court made these remarks while hearing a matter regarding reservation benefits for the creamy layer of Backward Classes.

A bench led by Justice B V Nagarathna questioned the continued demand for quota benefits by families that have already achieved educational and economic advancement. The Supreme Court asked about the rationale behind extending reservation benefits to children whose both parents are IAS officers.

"Social mobility is there. Now there are Government orders excluding all these people, and they are questioning the exclusion. This also has to be kept in mind.. The parents of students are in good jobs, getting good income, and the children want reservation again. See, they should get out of reservation," Justice Nagarathna observed.

During the hearing, the Supreme Court also raised concerns over families continuing to claim reservation benefits despite having attained social and economic progress through the quota system. “If both parents are IAS officers, why should reservation still be required?” the court remarked. as reported byNews18..

The observation is importance because, in the November 2022 ruling that upheld the 10 per cent EWS reservation, four of the seven judges had supported extending the creamy layer concept to Scheduled Castes and Scheduled Tribes as well, on the lines of its application to Other Backward Classes.

The bench further observed that the eligibility of the next generation for such benefits should be reconsidered. once families achieve a certain degree of educational and economic advancement through reservation benefits.

“There has to be some balance. Socially and educationally backward, yes, but once the parents have attained a level because of taking advantage of reservation…" the judge observed during the hearing.

The court also highlighted the difference between reservation granted to economically weaker sections (EWS) and quotas meant for socially disadvantaged communities.

The bench also stressed that social mobility comes with educational and economic progress. “With educational and economic empowerment, there is social mobility. So then again, to seek reservation for the children, we will never get out of it. That is a matter we have to concern also," the bench stated.
